Terms and Conditions
These Terms & Conditions form the basis of a Contract between You and The Company. Please take the time to read through this document carefully; the following words have the following definitions:
- ‘The Company’ means Mer-mummies
- ‘We’ ‘Us’ or ‘Our’ means The Company
- ‘You’ or ‘Your’ means the person(s) accepting this Contract
- ‘Course’ means a block of classes or lessons running once each week concurrently. Different courses have a differing number of classes/lessons.
- ‘Classes’ means a single event lasting a specific amount of time. E.g. one aquanatal class lasts 45mins
- ‘Instructor’ or ‘Teacher’ means an Employee provided by The Company who shall teach the Lessons
- ‘Premises’ means the specific pools/rooms hired for classes
By making a booking and payment, you agree to our terms and conditions and to attend your classes for the whole block, pass duration or course.
Conditions applying to all Classes/Courses
GENERAL RULES:
A copy of the Company public liability insurance policy provided by Balens/FEDANT is available upon request.
Aqua-natal Classes
HEALTH SCREENING DECLARATION:
Before joining your first class, you will be asked to complete a health history screening form, this is part of safety procedures and your record will remain confidential and stored using correct data protection methods. You will not be able to start classes without this being completed, signed and dated electronically.
There maybe occasions whereby Mer-mummies recommends that you seek medical opinion before commencing any aquanatal classes.
It is your responsibility to update Mer-mummies before each class if anything has changed from the original form completed. Mer-mummies will endeavour to ask verbally about any changes prior to each class as a reminder. Any significant changes will result in a new health screening form to be completed.
If you have any special needs it is advisable to discuss these with the instructor before committing yourself to the class.
REFUNDS AND CANCELLATIONS:
Once the block has started, we are unable to offer any refund and 100% cancellation fees are applicable. If you wish to withdraw from the block on medical grounds then we require a formal letter of withdrawal and request for a refund from you. Any refund given on these grounds shall be apportioned according to the number of classes remaining in the course, from the date of receipt of your written notification. The refund will then be sent directly back to you by the same means payment was sent.
Mer-mummies is under no obligation to refund or transfer any monies in the event that you are unable to attend part of or the entire course. However when enough notice is given (minimum 2 weeks) I will endeavour to fill your missed space/s. If spaces are filled, I will offer you a refund or a credit for another class. This is not guaranteed, simply a goodwill gesture.
If you give birth prior to the end of your block booked, I am unable to offer a refund. As a sign of goodwill I will endeavour to readvertise your space and if filled, a partial refund will be offered in line with the number of classes missed.
When the pool is closed or we cancel a class for any reason, we will refund or leave your account in credit at the current weekly class rate.
We are not responsible for delays outside our control including, without limitation: (a) acts of God, flood, drought, earthquake or other natural disaster; (b) epidemic or pandemic (including any existing epidemic or pandemic); (c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation of war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; (d) nuclear, chemical or biological contamination or sonic boom; (e) any law or any action taken by a government or public authority; (f) collapse of buildings, fire, explosion or accident; (g) any strikes, industrial action or lockouts; (h) non-performance by suppliers or subcontractors; and (i) interruption or failure of utility service.
Payments, Accounts & Gift Vouchers:
PAYMENTS:
New & renewal bookings – payments will be made online via Stripe – secure booking system.

Gift vouchers are non-refundable, are not exchanged for cash. They are valid for 12 months from the date of purchase.
PRIORITY RENEWAL:
Demand for places in our classes is very high; priority booking for subsequent blocks is always given to existing Mer-mummies. Mer-mummies will always notify exisiting clients when places are available to book online before notifying the waiting list or advertising externally. Refunds can only be issued on medical grounds of a health care professional in writing. If a block is cancelled at any time – I am only able to issue a refund if the space can be filled by another client.
PROMOTIONS & OFFERS:
Promotions and offers are non-refundable, are not exchanged for cash and are not transferable to other Mer-mummies customers. They are valid for the duration of the promotion as stated at the time of communication, and cannot be redeemed in conjunction with other offers. When redeeming, please quote the promotional reference contained in our correspondence. We reserve the right to withdraw promotional codes at any time.
HOLIDAYS:
Mer-mummies will take various weeks off over the year and these will be factored into the advertised blocks available to book
COMPLAINTS:
In the event of a complaint arising, you should initially send your concerns to clare@mermummies.com.
OUR GUARANTEE:
I guarantee to provide you with safe, evidence based classes that enhance your pregnancy and beyond experience. Building confidence, from a suitably qualified individual.
LIABILITIES:
The Company is not liable for any damage or loss to property whilst in the premises (whether being worn or left in the pool/changing rooms) or within the grounds/car park of the premises.
The Company will not accept any liability for any accident or injury (including any fatality) to any visitor that may occur on the premises or within the grounds/car park of the premises, other than liability which may arise from the negligence of the Company, its staff or its agents. Any such incidents must be reported to the Company immediately.
Conditions applying to Swimming
SICKNESS:
If you, or anyone in the family has had sickness and/or diarrhoea in the 72hrs days prior to the lesson then you are requested not to attend classes
If you have a heavy cold, sinusitis, covid symptoms or an ear infection, you are requested not to attend. Refunds or credits are not given for sickness.
POOL CLOSURES AND CANCELLED CLASSES:
On rare occasions, pool closures or instructor availability may make it necessary to cancel lessons. If we need to cancel a lesson then we shall call all affected clients, if we do not reach you we will leave a message, we will also send you an email. If no mobile number is supplied then we shall call your home number. If no numbers are supplied we cannot be held responsible for being unable to give prior warning of cancellations or closures.
If we cancel a class for any reason (other than in the case of any delay outside our control in which case the provisions set out above shall apply or in the event of pool closures for periods longer than one week due to matters within our reasonable control, in which case the provision set out below shall apply), we will return the cancelled class to your account as a credit to use against future classes or refunded as a payment.
In the event of pool closure for periods longer than one week due to matters within our reasonable control including structural failure, pool plant malfunction, water heating or quality problems, we will credit the value of the number of sessions lost to your account to be used against other classes or returned as a refund.
ANTENATAL/POSTNATAL /BABY MASSAGE BOOKINGS
ALL CLASSES
Refunds cannot be made for any missed classes.
BABY MASSAGE AND ANTENATAL CLASSES
Refunds and Cancellations:
Once the course has started, we are unable to offer any refund and 100% cancellation fees are applicable. In relation to antenatal classes a £50 non refundable deposit is taken at booking. The balance is due 14 days before date of first session. Non payment and cancellation within that 14 days will result in being liable for full payment of course.
If you cancel your booking more than four weeks before the start of the course, your deposit will be forfeited.
If you cancel your booking between 2 and 4 weeks before the start of the course, you will be liable to pay 50% of full course fee.
If your baby arrives before or during the course, we will issue you a pro rata refund depending of number of classes attended. The £50 deposit will remain non refundable for admin purposes.
If there is a not enough people booked on the course, we may need to cancel your booking. If we do, we will always offer 121 classes at the same cost (mileage dependant) or a full refund sent directly back to you by the same means payment was sent.
Mer-mummies is under no obligation to refund or transfer any monies in the event that you are unable to attend part of or the entire course.
If the hall/ place of class has to be closed for unforseen reasons we will refund or leave your account in credit at the current weekly class rate, or make alternative arrangements for a catch up class.
If you cancel your baby massage class, we will attempt to move you to a more suitable class at a later date if spaces permit. If you cancel more than 4 weeks before the start date you will be charged a £10 admin fee and remainder refunded. Cancellation between 2-4 weeks will result in 50% refund and less than 2 weeks no refund made. If space can be filled then a £10 admin fee will apply and remainder refunded.
121 SESSIONS
A non refundable deposit of £50 is required to secure your booking at the time of quote/invoice provided. The remaining balance is due on the day of your first session.
Session times are flexible and agreed in advance – for one off postnatal services I will always be as flexible as possible – however on some occasions, work and personal commitments will be put first.
Simple questionnaires gathering basic personal information may be used to tailor personalised sessions – any data stored will be in line with GDPR principles and will only be retained during the duration of services being offered.
FULL MER-MUMMIES PACKAGE
Entitles the bearer to the following:
1 block of 4 consecutive aquanatal classes from next available spaces – priority access given to waiting list
Full antenatal education – either 4 week group course appropiate to due date or 2 x 121 personalised sessions at your home address.
Baby massage – either 5 week group course or a 121 master class in your home ( 1 session)
Payment is required in full at booking to benefit from discount – cancellation terms apply above.
